Off to Neverland Travel® (“OTN”, “we”, “us”, or “our”) respects your privacy. This Privacy Policy explains what personal information we collect about visitors to our website at offtoneverland.com and any related subdomains, microsites, and online services we operate (collectively, the “Site”), how we use it, who we share it with, and the choices and rights you have. It also explains how we use cookies, tracking pixels, and similar technologies, and how the law protects you.

By using the Site or providing your information to us, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Site or submit information to us.

Quick Summary

We collect the information you give us (like your name, contact details, and trip preferences) so our Magic Maker® advisors can plan your Disney and other vacations. We also collect technical information automatically through cookies and pixels to operate and improve the Site and to show you relevant ads. We share information with travel suppliers (Disney, cruise lines, hotels, etc.) to book your travel, with service providers who help us run our business, and with advertising and analytics partners. We do not sell your personal information for money, but some of our advertising practices may qualify as “sharing” or “selling” under certain state privacy laws, and you have the right to opt out. We do not knowingly collect information from children under 13 on the Site. See Section 11 for your privacy rights and how to exercise them.

1. Who We Are

Off to Neverland Travel® is a Disney-focused travel agency headquartered in Fort Worth, Texas. We are an EarMarked by Disney Authorized Travel Agency and a member of Travel Leaders Network. We are registered as a Seller of Travel with the State of Florida (Registration No. ST37203) and the State of California (CST No. 2090317-40).

This Privacy Policy applies to the personal information we collect as the business responsible for deciding how it is used (the “controller” under certain privacy laws). It also describes information our independent contractor travel advisors (“Magic Maker®” advisors) collect on our behalf when serving you.

2. Scope of This Policy

This Privacy Policy applies to information we collect:

  • Through the Site and any forms, quote requests, contact pages, or sign-up tools on it;
  • Through emails, phone calls, text messages, and other communications between you and our Magic Maker® advisors or staff;
  • Through our social media pages (Facebook, Instagram, X/Twitter, etc.) where we interact with you;
  • Through events, conferences, or marketing activities we host or participate in; and
  • From third-party suppliers, technology vendors, and marketing partners we work with to provide our services.

This Privacy Policy does not cover the practices of third parties whose websites we link to, including Disney, cruise lines, resorts, airlines, or other travel suppliers. Once you leave our Site or book directly with a supplier, that supplier’s privacy policy applies. We encourage you to read the privacy policies of any third-party sites you visit.

3. Information We Collect

3.1 Information You Provide to Us

When you contact us, request a quote, become a client, sign up for our email list, or otherwise interact with us, we may collect:

  • Identity and Contact Information: legal first and last name (as it appears on government-issued identification), preferred name, physical mailing address, email address, and telephone number(s).
  • Travel Preferences and Trip Details: destinations, travel dates, length of stay, budget, special occasions, accommodation preferences, dining preferences, party size, and similar details necessary to plan your vacation.
  • Information About Other Travelers in Your Party: legal names, dates of birth, ages of any minor children, and similar details required by travel suppliers. You represent that you have authority to share this information with us on behalf of others in your party, including parents or legal guardians of minor children.
  • Travel Document Information: when required by a supplier, passport numbers, government-issued IDs, frequent traveler numbers, Disney account information, and similar identifiers.
  • Sensitive Information for Travel Accommodations: food allergies, medical conditions, mobility needs, and other disability- or accessibility-related information that you choose to share so we can request appropriate accommodations from travel suppliers. We treat this information as sensitive and use it only for the purposes you provide it.
  • Payment Information: when you pay deposits, fees, or other charges to OTN, your payment card information is collected and processed by our payment processors (currently Square and Stripe). OTN does not retain full payment card numbers. When you pay travel suppliers directly, their payment processors handle that information under their own terms. Payment card information you provide to OTN by phone, email, or in writing for a single transaction is destroyed after the transaction is processed and is not retained.
  • Communications: the content of emails, text messages, voicemails, social media messages, and other correspondence between you and us.
  • Marketing Preferences: your choices about receiving our “Neverland News” newsletter and other marketing communications.
  • Feedback and Reviews: survey responses, testimonials, photos you share with us, and similar content.

3.2 Information Collected Automatically

When you visit the Site, we and our service providers automatically collect certain information using cookies, pixels, tags, and similar technologies (collectively, “Tracking Technologies”). This may include:

  • Device and Technical Data: IP address, approximate location (typically city or region) derived from your IP address, browser type and version, operating system, device type, screen size, language preference, time zone, and similar information.
  • Usage Data: pages you visit, links you click, time spent on pages, navigation paths, search terms used on the Site, referring URLs, and the date and time of your visits.
  • Cookie Identifiers: unique identifiers stored in cookies, local storage, or set by our advertising partners.

3.3 Information from Third Parties

We may receive information about you from:

  • Travel Suppliers: confirmation numbers, booking statuses, modifications, and similar information from Disney, cruise lines, hotels, airlines, and other suppliers we book on your behalf.
  • Marketing Partners: Travel Leaders Network and other industry partners may provide marketing leads or co-marketing data.
  • Advertising and Analytics Providers: Meta (Facebook/Instagram), Google, and similar platforms may provide aggregated reporting and audience information.
  • Social Media: if you interact with us on social media, we may receive your profile name, public posts, and similar information based on your privacy settings on that platform.
  • Publicly Available Sources: limited information from public records when necessary to verify identity, prevent fraud, or comply with law.

4. How We Use Your Information

We use the information we collect for the following purposes:

  • To plan and book your travel: respond to quote requests, prepare itineraries, communicate with travel suppliers, make reservations, modify bookings, and assist you before, during, and after your trip.
  • To communicate with you: answer questions, send confirmations, provide updates and travel information, and respond to support requests.
  • To send marketing communications: send our Neverland News email newsletter, special offers, vacation ideas, and similar marketing material if you have signed up or expressed interest. You can opt out at any time (see Section 11).
  • To operate and improve the Site: administer the Site, troubleshoot, analyze usage, measure the effectiveness of pages and content, and develop new features.
  • For advertising: show you ads about our services on third-party sites and platforms (including Meta and Google), measure the effectiveness of those ads, and build look-alike audiences of similar potential clients.
  • For business operations: internal reporting, training (including for our Magic Maker® advisors), and to support our relationships with Travel Leaders Network, Disney, and other partners.
  • To comply with law and protect rights: comply with legal obligations, including those imposed by the Florida Seller of Travel law, the California Seller of Travel law, and applicable consumer protection laws; respond to legal process; prevent fraud; and protect our rights and the rights of others.

5. Who We Share Your Information With

We share personal information with the following categories of recipients:

5.1 Travel Suppliers

To book and service your travel, we share necessary information with suppliers such as The Walt Disney Company and its affiliates (including Walt Disney World, Disneyland Resort, Disney Cruise Line, Adventures by Disney, Aulani, and Disney Vacation Club), other cruise lines, hotels, airlines, ground transportation providers, tour operators, and travel insurance providers. These suppliers process your information under their own privacy policies.

5.2 Magic Maker® Advisors (Independent Contractors)

Our Magic Maker® advisors are independent contractor travel advisors who work under the OTN brand. They have access to client information necessary to plan and service your travel, and are contractually required to keep your information confidential and to use it only for OTN-related purposes.

5.3 Service Providers

We share information with third-party service providers who help us run our business, including:

  • Customer relationship management (CRM), itinerary, and proposal software (Travefy, Inc.);
  • Website hosting, security, and email service providers;
  • Email marketing platform (SendStudio) for the Neverland News newsletter;
  • Payment processors (Square and Stripe) for deposits and fees paid to OTN;
  • Analytics providers (Google Analytics);
  • Advertising partners (Meta Platforms, Google Ads);
  • Accounting, legal, insurance, and other professional advisors.

These service providers are authorized to use your information only as needed to provide services to us, and are contractually required to protect it.

5.4 Marketing and Advertising Partners

We use Tracking Technologies that enable third parties such as Meta and Google to collect information about your visits to our Site for the purpose of showing you targeted advertising. Under certain state privacy laws (including the California Consumer Privacy Act and the Texas Data Privacy and Security Act), this activity may be considered “sharing” or “selling” of personal information, even though we receive no monetary payment. You have the right to opt out of this activity. See Section 11.

5.5 Travel Industry Affiliations

We share limited information with Travel Leaders Network and EarMarked by Disney for membership, certification, recognition, and co-marketing purposes.

5.6 Legal and Safety Disclosures

We may disclose information if we believe in good faith that disclosure is necessary to: (a) comply with a subpoena, court order, or other legal process; (b) enforce our agreements or protect our rights; (c) protect the safety of any person; (d) detect, prevent, or address fraud, security, or technical issues; or (e) comply with applicable law.

5.7 Business Transfers

If OTN is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of business assets, your information may be transferred as part of that transaction. We will notify you of any such transfer that materially affects how your personal information is handled.

6. Cookies and Tracking Technologies

We and our partners use cookies and similar technologies on the Site. These include:

  • Strictly Necessary Cookies: required for the Site to function (for example, security and load balancing). You cannot opt out of these.
  • Functional Cookies: remember your preferences and choices.
  • Analytics Cookies: help us understand how visitors use the Site. We use Google Analytics, which may set cookies and collect information about your use of the Site, including your IP address. See

6.1 Your Cookie Choices

When you first visit the Site, we present a cookie consent banner that allows you to accept all cookies, reject non-essential cookies, or customize your preferences. You can change your choices at any time by clicking the “Cookie Preferences” link in our website footer.

You can also control cookies through your browser settings. Most browsers allow you to refuse or delete cookies. Blocking some types of cookies may impact your experience on the Site.

6.2 Global Privacy Control

Our Site recognizes the Global Privacy Control (GPC) browser signal. If your browser sends a GPC signal, we will treat it as an opt-out of “sale” or “sharing” of personal information for cross-context behavioral advertising under applicable state laws.

6.3 Do Not Track

Some browsers offer a “Do Not Track” (DNT) setting. There is currently no industry standard for how DNT signals should be honored, and the Site does not respond to DNT signals at this time. We do honor the Global Privacy Control signal as described above.

7. Notice and Consent for Tracking Technologies

Florida’s Security of Communications Act (Florida Statutes Chapter 934) and similar laws in California, Massachusetts, and other states require that all parties to an electronic communication consent to its interception or recording. By using our Site after acknowledging our cookie consent banner, you affirmatively consent to our use of Tracking Technologies as described in Section 6, including the recording of your interactions with our Site for analytics, advertising, and Site improvement purposes, and the sharing of related data with our service providers and advertising partners.

You may withdraw your consent at any time by clicking the “Cookie Preferences” link in our website footer or by following the instructions in Section 11.

8. How Long We Keep Your Information

We retain personal information only as long as needed for the purposes described in this Privacy Policy, including:

  • Active client records: for the duration of our relationship and for a reasonable period thereafter to allow for repeat bookings, supplier inquiries, and customer support.
  • Booking and financial records: for at least three (3) years after the completion of travel, as required by the Florida Seller of Travel law, the California Seller of Travel law, and applicable tax and accounting rules. We may retain records longer where required by law.
  • Marketing data: until you unsubscribe or opt out, plus a brief period to process your request.
  • Website analytics data: generally retained for 14 to 26 months in our analytics tools, then aggregated or deleted.
  • Legal holds: if we are subject to a legal hold, investigation, audit, or litigation, we may retain information longer than the periods above.

9. How We Protect Your Information

We use commercially reasonable administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, use, disclosure, alteration, or destruction. These include encryption in transit, access controls limiting employee and contractor access to information on a need-to-know basis, secure third-party hosting, and contractual confidentiality obligations on our Magic Maker® advisors and service providers.

No method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security. If we become aware of a security breach affecting your personal information, we will notify you and applicable regulators as required by law.

10. Children’s Privacy

Our Site is intended for adults planning Disney and other vacations. The Site is not directed to children under the age of 13, and we do not knowingly collect personal information directly from children under 13 through the Site in violation of the Children’s Online Privacy Protection Act (“COPPA”).

As a Disney-focused travel agency, we routinely collect information about children (such as a child’s first name, age, dietary restrictions, character preferences, and special celebrations) from their parents or legal guardians for the purpose of planning family vacations. When you provide information about a minor child as part of a trip request, you represent that you are the child’s parent or legal guardian, or that you have permission from a parent or legal guardian to share that information with us. We use such information only to plan and service the family’s travel.

If you believe a child under 13 has provided personal information to us directly through the Site without parental consent, please contact us at the address below and we will delete that information promptly.

11. Your Privacy Rights and Choices

11.1 Rights Available to Everyone

Regardless of where you live, you may:

  • Unsubscribe from marketing emails by clicking the “unsubscribe” link at the bottom of any marketing email we send, or by emailing us at guestservices@offtoneverland.com. You will continue to receive transactional communications about trips you have booked.
  • Update your information by contacting your Magic Maker® or emailing us.
  • Request deletion of your account by emailing us. Note that we may retain certain information as required by law or as described in Section 8.
  • Adjust your cookie preferences through our cookie consent banner or the “Cookie Preferences” link in our footer.

11.2 Residents of California

If you are a California resident, the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), provides you with the following rights:

  • Right to know what categories of personal information we have collected, the sources, the purposes for collection, the categories of recipients, and the specific pieces of personal information we have about you.
  • Right to delete personal information we have collected from you, subject to certain exceptions.
  • Right to correct inaccurate personal information.
  • Right to opt out of sale or sharing of your personal information. We do not sell personal information for money, but our use of advertising cookies and pixels (including the Meta Pixel and Google Ads tags) may qualify as “sharing” for cross-context behavioral advertising.
  • Right to limit use of sensitive personal information. We generally do not use sensitive personal information (as defined under California law) for purposes that would trigger this right.
  • Right to non-discrimination for exercising your privacy rights.

To exercise your CCPA rights, email guestservices@offtoneverland.com or call 817-886-0983. We will respond within the time frames required by law. You may also designate an authorized agent to make a request on your behalf; we will require reasonable verification of identity and authority. To opt out of “sharing,” adjust your cookie preferences or send a Global Privacy Control signal.

California Shine the Light. California Civil Code Section 1798.83 permits California residents to request information about disclosures of personal information to third parties for direct marketing purposes. You may submit such a request to guestservices@offtoneverland.com.

11.3 Residents of Texas, Virginia, Colorado, Connecticut, Utah, and Other States

If you are a resident of a state with a comprehensive consumer privacy law (including the Texas Data Privacy and Security Act), you may have rights to:

  • Confirm whether we process your personal data and access that data;
  • Correct inaccuracies;
  • Delete personal data you provided or that we obtained about you;
  • Obtain a copy of your personal data in a portable, readily usable format; and
  • Opt out of targeted advertising, the sale of personal data, and certain profiling activities.

11.4 Residents of Florida

Florida residents have rights under the Florida Digital Bill of Rights, which applies to certain large businesses. While OTN may not currently meet the size thresholds that make the Florida Digital Bill of Rights apply, we extend the access, correction, deletion, and opt-out rights described in Section 11.3 to Florida residents as a matter of practice. Contact us using the information in Section 13 to exercise these rights.

11.5 Residents of the European Economic Area, United Kingdom, and Canada

Our services are directed to residents of the United States. We do not actively market to residents of the EEA, UK, or Canada. If you reside in one of those jurisdictions and choose to contact us or book travel through us, additional rights may apply under the GDPR, UK GDPR, or Canadian privacy laws (including PIPEDA), including rights of access, rectification, erasure, restriction of processing, data portability, and the right to lodge a complaint with a supervisory authority. Contact us using the information in Section 13.

12. Third-Party Links and Social Media

The Site contains links to third-party websites and embedded content from third-party platforms (including Instagram, Facebook, and YouTube). We do not control these third parties, and this Privacy Policy does not apply to them. Interactions with embedded social media content (such as Instagram feeds) may be subject to the privacy policies of those platforms. We encourage you to review the privacy policy of any third party before sharing information with them.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other reasons. When we make material changes, we will update the “Effective Date” above and may notify you through the Site or by email. Your continued use of the Site after a change takes effect constitutes acceptance of the updated Privacy Policy.
