PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING LIMITATIONS ON OUR LIABILITY AND A REQUIRED VENUE AND CHOICE-OF-LAW PROVISION. BY USING OUR WEBSITE, YOU AGREE TO THESE TERMS.

These Website Terms of Use (“Terms”) are a binding agreement between you (“you” or “your”) and Off to Neverland Travel® (“OTN”, “we”, “us”, or “our”). These Terms govern your access to and use of the website located at offtoneverland.com and any related subdomains, microsites, and online services we operate (collectively, the “Site”).

These Terms do not govern travel-planning, booking, or other client services provided by OTN. If you engage OTN to plan or book travel, separate Client Terms and Conditions will apply to those services and will be provided to you for review and acceptance before you become a client.

Our Privacy Policy is incorporated into these Terms by reference. By using the Site, you also agree to the Privacy Policy.

1. License to Use the Site

Subject to your compliance with these Terms, OTN grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for the purpose of learning about our travel-planning services and contacting us. This license does not include any right to:

  • Copy, reproduce, or republish Site content for commercial use;
  • Modify, adapt, translate, reverse-engineer, decompile, or disassemble any portion of the Site;
  • Frame or mirror the Site on another site;
  • Use any data-mining, robot, scraping, or similar automated data-gathering or extraction tool to access the Site;
  • Use the Site or its content to develop any competing service or website; or
  • Use or incorporate the Site or its content into any large language model, machine-learning dataset, generative AI tool, or automated decision-making system.

We may suspend or terminate this license at any time, with or without notice, for any reason.

2. Intellectual Property

The Site and its content — including text, graphics, images, photos, video, logos, software, and the selection and arrangement of all of the foregoing — are owned by or licensed to OTN and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

Off to Neverland Travel® and Magic Maker® are trademarks and service marks of Off to Neverland Travel. Unauthorized use is prohibited.

“Disney,” “Walt Disney World,” “Disneyland,” “Disney Cruise Line,” “Adventures by Disney,” “Aulani,” and related logos, characters, and properties are trademarks of The Walt Disney Company or its affiliates. OTN is an EarMarked by Disney Authorized Travel Agency. OTN is not owned, operated by, or otherwise affiliated with The Walt Disney Company beyond our authorized travel agency relationship. The use of Disney trademarks on this Site is for descriptive purposes only and does not imply endorsement or sponsorship by Disney except as expressly stated.

Other third-party trademarks (including Royal Caribbean, Universal Orlando, and other cruise lines, hotels, theme parks, and travel suppliers referenced on the Site) are the property of their respective owners and are used for descriptive purposes only.

3. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
  • Submit false, misleading, or fraudulent information through any form on the Site;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Upload or transmit viruses, malware, or other harmful code;
  • Attempt to gain unauthorized access to any part of the Site, our servers, or any system connected to the Site;
  • Interfere with the operation of the Site or other users’ use of it;
  • Harvest or collect any personally identifiable information about other users;
  • Send unsolicited communications, advertising, or spam through any feature of the Site; or
  • Use the Site in any manner that could damage, disable, overburden, or impair OTN systems or networks.

4. Forms and Submissions

The Site may include contact forms, quote-request forms, and other features that allow you to submit information to us. By submitting information through the Site, you represent that:

  • All information you submit is true, accurate, and complete;
  • You are at least 18 years of age and have legal capacity to enter into these Terms;
  • If you submit information about other individuals (including family members or travelers in your party), you have authority to provide that information to us; and
  • You acknowledge that submitting a form does not create a contract for travel services. Travel services are provided only under separate Client Terms and Conditions that you will be asked to review and accept before becoming a client.

Your submitted information is handled in accordance with our Privacy Policy.

5. Third-Party Links and Embedded Content

The Site may contain links to third-party websites (including Disney, cruise lines, resorts, and other travel suppliers) and embed third-party content (including Instagram, YouTube, and Facebook content). OTN does not control these third-party resources and is not responsible for their content, accuracy, privacy practices, or terms of use. Links and embedded content do not imply OTN’s endorsement of the linked or embedded material. When you leave the Site, you do so at your own risk, and the terms and privacy policies of the third-party site apply.

6. Testimonials and User Submissions

If you submit a review, testimonial, comment, photo, or other content to OTN through the Site or social media (collectively, “User Content”), you grant OTN a perpetual, worldwide, royalty-free, non-exclusive, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from that User Content in any media for marketing, promotional, training, and business purposes.

You represent that:

  • You own or control all rights in your User Content;
  • Your User Content does not violate the rights of any third party, including copyright, trademark, privacy, or publicity rights;
  • You have all consents required to grant the license above, including consents from any other individuals depicted in or referenced by the User Content (such as photo subjects and family members); and
  • Your User Content is accurate, lawful, and not defamatory, obscene, or otherwise objectionable.

OTN may remove, edit, or refuse to publish any User Content at our sole discretion.

7. Cookies and Tracking Technologies

The Site uses cookies, pixels, and similar tracking technologies. Your use of these technologies is governed by our Privacy Policy and managed through our cookie consent banner. You may change your preferences at any time using the “Cookie Preferences” link in the Site footer.

8. Restricted Access Areas

Certain areas of the Site may be restricted to authorized users (including Magic Maker® advisor login portals). If you have been granted login credentials for any restricted area, you agree to:

  • Keep your credentials confidential and not share them with any other person;
  • Use the restricted area only for its intended purpose and only as authorized by OTN;
  • Notify OTN immediately if you suspect unauthorized use of your credentials; and
  • Comply with any additional terms applicable to the restricted area.

OTN may revoke access to any restricted area at any time, with or without notice.

9. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, OTN DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, OTN DOES NOT WARRANT THAT (A) THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) THE SITE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (C) INFORMATION ON THE SITE IS ACCURATE, CURRENT, OR COMPLETE. INFORMATION ABOUT DESTINATIONS, PRICES, AVAILABILITY, SUPPLIER POLICIES, AND TRAVEL CONDITIONS IS SUBJECT TO CHANGE WITHOUT NOTICE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OTN AND ITS OWNERS, OFFICERS, EMPLOYEES, MAGIC MAKER® ADVISORS, AGENTS, AND AFFILIATES (COLLECTIVELY, THE “OTN PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING DAMAGES FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF OTN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF THE OTN PARTIES TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

These limitations apply regardless of the legal theory — contract, tort (including negligence), strict liability, or otherwise — and apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

This Section 10 governs liability arising from your use of the Site only. Liability arising from travel-planning or booking services is governed by the separate Client Terms and Conditions that apply to those services.

11. Indemnification

You agree to indemnify, defend, and hold harmless the OTN Parties from any claim, demand, loss, damage, liability, cost, or expense (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; (d) any User Content you submit; or (e) any inaccurate, false, or misleading information you submit through the Site.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any lawsuit, action, or proceeding arising out of or related to these Terms or your use of the Site shall be filed exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of those courts.

13. Time Limit on Claims

Any claim arising out of or related to these Terms or your use of the Site must be brought within one (1) year after the claim arose, or it is permanently barred. This limitation applies to the fullest extent permitted by law.

14. Changes to These Terms

OTN may update these Terms from time to time. When we make material changes, we will update the Effective Date above and post the updated Terms on the Site. Your continued use of the Site after a change constitutes acceptance of the updated Terms.

15. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and OTN regarding your use of the Site. Separate Client Terms and Conditions govern any travel-planning or booking services.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision or our right to enforce it later.

Assignment. You may not assign these Terms or your rights under them without our prior written consent. OTN may assign these Terms freely.

No Agency or Joint Venture. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and OTN.

Headings. Section headings are for convenience only and do not affect interpretation.
